Australia – Crown clears legal challenge to Barangaroo

Australian operator Crown Resorts has cleared what could be the last legal hurdle before it can build its A$2bn VIP Barangaroo casino in Sydney.

A community group called Millers Point Fund Incorporated filed legal action against Crown last month, claiming the proposed casino would occupy a site that had previously been reserved for a foreshore park. It said the New South Wales Planning Commission had violated the state’s Casino Control Act.

However the courts ruled there had been no ‘jurisdictional error’ in granting Crown Resorts approval for its project with Millers Point Fund Incorporated having to pay the legal costs relating to the lawsuit.

Crown stated: “The legal challenge brought by the Millers Point Fund Incorporated, as applicant, challenging the validity of the decision of the NSW Planning Assessment Commission to approve the applications for the modification of the approved concept plan for Barangaroo and for the construction of the Crown Sydney Hotel Resort at Barangaroo South has been dismissed by the Land and Environment Court of NSW. Crown is pleased with the decision and looks forward to continue building an iconic, six-star hotel resort of which Sydney and Australia can be proud. It is expected that Crown Sydney will be completed in 2021.”
