Legislative proposals on betting advertising to be discussed in Brazilian senate

The proposals to prohibit betting advertising  (PL 2985/2023), and to ban athletes and celebrities from promoting sports betting platforms (PL 3405/2023) will be discussed in a public hearing held by the Sports Commission (CEsp) according to Agência Senado.

The hearing responds to requests from Senators Carlos Portinho and Jorge Kajuru. The author of PL 2985/2023 is Senator Styvenson Valentim, who argues that, given the economic power amassed by betting companies, the legislature should act to set limits on the industry. Portinho serves as the rapporteur for this proposal.

On the other hand, PL 3405/2023, authored by Senator Eduardo Girão, serves a similar purpose. The rapporteur for this bill is Senator Sérgio Petecão. This proposal seeks to amend the law regulating betting by prohibiting advertising conducted by sports teams, athletes, former athletes, and presenters or commentators across any medium. It also bans ads by celebrities, digital influencers, or other individuals, as defined by regulation, who may significantly sway public behaviour.

Earlier this month at a public hearing of the Sports Commission (CEsp) senators and experts questioned the effectiveness of legal restrictions on gambling advertisements, which took full effect in January 2025.
