The Netherlands – Toto Online fined by Dutch Gambling Authority KSA

By - 29 November 2022

The Dutch Gaming Authority has imposed a fine of €400,000 on Toto Online after the operator targeted advertising to young adults, 18 to 23 year olds, which is forbidden.

The Ksa found that From 1 October 2021 (the date on which the legal market for online gambling opened) to 1 February 2022, Toto Online sent advertising messages to its total customer base. In addition, advertising, including bonus offers, has been sent to young adults. The gaming provider should not have done that. It is forbidden to send advertising to young adults. Toto Online stopped the violation as of 1 February 2022.
René Jansen, chairman of the Ksa, said: “The law says that vulnerable groups, including young adults, must be given extra protection. The brains of young people are still developing. As a result, they are extra vulnerable to developing gambling addiction. Gambling providers must fully respect the rules intended to protect vulnerable groups. That didn’t happen here and that’s why this fine.”
