Colombia – New Resolution seeks to make Coljuegos advertising regulator

Coljuegos has published a resolution that would give it authority to supervise standards for gaming advertising effectively making it the advertising regulator over the industry. If approved Coljuegos would be able to create rules for advertising, sponsorship, promotion or any other form of commercial communication over online gambling starting at the beginning of next year.

It was first put forward to the government at the end of last month.  The objective of the bill is to put in place a series of new rules to “regulate the conditions under which authorised operators can promote advertising, sponsorship, marketing or any other form of commercial communication activities in Colombia.”

The legislation aims to control the conditions under which authorized operators advertise in the country. Comments on the new project were received up until the end of last month.

 According to the resolution teams and clubs will not be able to enter into sponsorship deals with companies that do not have permission to operate from Coljuegos. When it comes to video or social media platforms, the bill establishes that sports betting operators may promote their activities, as long as a series of requirements are met.

However, the bill will likely  caused some controversy as it doesn’t just cover advertising because it puts in place mandatory requirements on operators to establish mechanisms and protocols built to detect signs of gambling harm and prevent those users from receiving gambling communications. In addition the final published version of the resolution also states that online operators will only be able to accept deposits from consumers using prepaid credit cards and places restrictions on how much gambling firms may spend on advertising.  Limits on marketing content will be based on gross gaming revenue (GGR) and other variables will be specific to each operator.
